1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the Cascades Casino Events mobile application ("App"), developed and operated by Ink Ajalo ("Developer," "we," "us," or "our").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not download, install, or use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the modified Terms.

2. Description of Service

Cascades Casino Events is a premium iOS companion application that provides informational content about Cascades Casino Resort. The App offers:

• Information about events and entertainment
• Details about promotions and special offers
• Dining venue information and menus
• Gaming facility overviews
• Hotel and spa information
• Rewards program details
• Personal planning features (favorites, itinerary)

2.1 Nature of the App

IMPORTANT: The App is strictly an informational platform. The App does NOT:

• Facilitate, offer, or promote gambling or betting of any kind
• Process or enable bookings, reservations, or appointments
• Handle payments, transactions, or financial operations
• Provide gambling simulations or gaming mechanics
• Guarantee availability of events, promotions, or services
• Act as an official representative of Cascades Casino Resort

3. Eligibility

To use this App, you must:

• Be at least 17 years of age
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the App under applicable laws

By using the App, you represent and warrant that you meet all eligibility requirements.

The App, including its design, features, functionality, and content created by us, is owned by Ink Ajalo and is protected by copyright, trademark, and other intellectual property laws.

6.2 Third-Party Content

The App displays information about Cascades Casino Resort, which is sourced from cascadescasino.ca and other public sources. This content remains the property of its respective owners. We do not claim ownership of third-party content displayed in the App.

6.3 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal iOS device
• Use the App for personal, non-commercial purposes

This license does not permit you to:

• Modify, adapt, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices
• Transfer your rights to any third party

6.4 Trademarks

"Cascades Casino," "Cascades Casino Resort," and related trademarks are the property of their respective owners. The App name "Cascades Casino Events" is used to describe the App's function and is not intended to imply affiliation or endorsement.

7. Content and Information

The App displays information sourced from third parties. We are not responsible for the accuracy or reliability of third-party content. Always verify important information directly with the venue.

7.3 No Endorsement

Display of information about events, promotions, or services does not constitute our endorsement or recommendation.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

9.2 No Professional Advice

The App does not provide professional, financial, legal, or gambling advice. Information is for general informational purposes only.

9.3 Venue Relationship

We are not affiliated with, endorsed by, or an official representative of Cascades Casino Resort or Gateway Casinos & Entertainment Limited. The App is an independent informational service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• THE DEVELOPER SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
• THE DEVELOPER'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY)

These limitations apply regardless of the theory of liability and even if the Developer has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Developer and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the App

12. Third-Party Services and Links

The App may contain links to or integrate with third-party websites, services, or applications. We are not responsible for:

• The content, accuracy, or practices of third-party services
• Any transactions you conduct with third parties
• Any damages arising from your use of third-party services

Your use of third-party services is at your own risk and subject to their terms and policies.

13. App Store Terms

Your download and use of the App is also subject to the Apple App Store Terms of Service. In the event of any conflict between these Terms and the App Store Terms, the App Store Terms shall prevail with respect to your relationship with Apple.

Apple is not responsible for:

• The App or its content
• Maintenance or support services for the App
• Any claims related to the App
• Intellectual property claims related to the App

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the App will cease immediately
• You must delete the App from your device
• Provisions that by their nature should survive termination will survive

15. Changes to the App

We reserve the right to:

• Modify, update, or discontinue the App at any time
• Change features or functionality without notice
• Remove content or services at our discretion

We are not liable for any modification, suspension, or discontinuance of the App.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Negotiation: We encourage you to contact us first to resolve any issues informally
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules

You agree to waive any right to participate in class action lawsuits or class-wide arbitration.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by the Developer.

19. Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements and understandings.

21. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
